Terms of Use

These Terms of Use ("Terms") govern your access to and use of the mobile application Safia ("the App"), owned and operated by NTBIES SRL, a company incorporated under Belgian law with its registered office at Avenue Herrmann Debroux 54, 1160 Auderghem, Belgium, VAT number BE1001972287 ("the Company," "we," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

Eligibility and Anonymous Use

The App may only be used by individuals who are at least sixteen (16) years old. Safia does not require account creation or authentication. All users access the App anonymously as guests. No personally identifiable information (PII) is collected, stored, or processed at any point during your use of the App.

Ghost Protocol

Safia operates under a Ghost Protocol, a zero-PII architecture designed so that no user can be identified, tracked, or profiled through the App. All guest data, including preferences, is automatically and permanently erased every thirty (30) days. There are no user accounts, no login credentials, and no persistent identifiers linking activity between resets.

Purpose of the App

Safia provides users with access to services that require the collection of geolocation data in order to function properly. The App relies on your current location to deliver its core features. Location data is used exclusively in real time to display and submit reports and is never stored in association with any personal identifier. By using the App, you expressly consent to the collection and processing of your location data as described in our Privacy Policy.

User Obligations

You agree to use the App in compliance with applicable laws and regulations. You must not misuse the App in any way, including but not limited to attempting to gain unauthorized access to the App or its servers, interfering with the normal operation of the App, submitting false or misleading information, or using the App in a manner that infringes the rights of others.

Intellectual Property

All content, design elements, software, trademarks, and other intellectual property made available through the App are the exclusive property of NTBIES SRL or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from the App or any part of it without our prior written consent.

User Content, License Grant, and Ownership

By submitting, uploading, or otherwise providing any content, including but not limited to incident reports, text, images, videos, or other media (collectively, "User Content") through the App, you represent and warrant that you have all necessary rights to do so and that such User Content does not infringe the rights of any third party.

You grant NTBIES SRL and its affiliates, including Safia, a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content, in whole or in part, in any form, media, or technology, whether now known or later developed, for the purposes of operating, improving, and promoting the App and related services.

All User Content submitted through the App becomes the exclusive property of NTBIES SRL upon submission. You acknowledge that User Content is submitted anonymously and cannot be attributed to any individual. You acknowledge that you will not be entitled to any compensation for the use of your User Content as described above.

Data and Privacy

We collect and process data in accordance with our Privacy Policy, which forms an integral part of these Terms. Safia follows a strict zero-PII architecture: no personal data is collected, no accounts exist, and all guest data is erased every thirty (30) days. The Privacy Policy explains how we handle data hosted on Firebase in Europe and clarifies that no personal data is stored on servers hosted by third parties such as Hostkey. By using the App, you acknowledge and agree to this processing.

Availability and Updates

We strive to maintain the availability and proper functioning of the App but cannot guarantee that it will always operate without interruption, error, or defect. We reserve the right to update, modify, suspend, or discontinue the App, in whole or in part, at any time without prior notice.

Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the App is at your sole risk.

Limitation of Liability

To the maximum extent permitted by law, NTBIES SRL shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses arising from or related to your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to use the App, if any, during the six (6) months preceding the event giving rise to the claim.

Termination

We may restrict or terminate access to the App at any time if we reasonably believe that usage patterns indicate a violation of these Terms, unlawful conduct, or use of the App in a way that could harm us, other users, or third parties. Since no accounts exist, termination applies at the device or network level.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles. Any dispute arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the competent courts of Brussels, Belgium.

Changes to the Terms

We may revise these Terms from time to time to reflect changes in law, technical developments, or business needs. The most current version will be available within the App and will supersede all previous versions. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
